These Terms of Service ("Terms") govern your use of the website esimcruise.com and the eSIM data services (the "Service") offered by Black Fin LTD, a company incorporated in Cyprus, registration number HE471760, VAT 60153090W, registered office at Homer Buildings, 20 Homer Avenue, 1097 Nicosia, Cyprus ("we", "us", "our"). By placing an order or using the Service you agree to these Terms.

2. Definitions
- "Service" means the resale and delivery of eSIM data plans through esimcruise.com.
- "eSIM" means an embedded SIM profile delivered as a QR code installable on a compatible device.
- "GigSky" means GigSky, Inc., the eSIM provider whose network and platform power the Service.
- "Plan" means a specific data package (data volume, validity, coverage) listed on the website.
- "Customer", "you" means the natural person who places an order.
3. Eligibility
You must be at least 18 years old and have full legal capacity to enter into a binding contract.
You must own or use an eSIM-compatible, carrier-unlocked device. A list of supported devices is available on the Device Compatibility page. We are not responsible for incompatibility you can verify before purchase.
4. Description of the Service
We resell mobile data connectivity provisioned by GigSky over partner mobile networks worldwide. Coverage, available technologies (4G/LTE, 5G), throughput and latency depend on GigSky and the underlying carriers and may vary at sea, in port and on shore.
Coverage maps and technical descriptions on the website are indicative and are not a guarantee of service in any specific location, vessel or moment in time.
5. Orders, prices and contract formation
Prices are displayed in US dollars (USD) and are inclusive of any VAT or other indirect taxes that may apply, unless stated otherwise.
Your order placed on the website constitutes an offer to purchase. The contract is concluded when we send you an order confirmation by e-mail with your eSIM QR code.
We may refuse or cancel an order in cases of suspected fraud, payment failure, sanctions screening, or material error in pricing or product description.
6. Payment
Payments are processed by Stripe Payments Europe, Limited and its affiliates. Card details are entered directly into the Stripe-hosted checkout and are never stored on our servers.
Strong Customer Authentication (3-D Secure) may be required by your card issuer. We are not liable for transactions declined by your bank.
7. Delivery of the eSIM
Once payment is confirmed, the eSIM QR code is delivered by e-mail, normally within minutes, to the address you provided at checkout. It is your responsibility to provide a valid, accessible e-mail address and to check the spam/junk folder.
If you do not receive the QR code within one (1) hour of payment, contact us at hello@esimcruise.com so we can resend it.
8. Right of withdrawal and refunds
The eSIM QR code is digital content not supplied on a tangible medium within the meaning of Article 16(m) of EU Directive 2011/83/EU on consumer rights.
By completing checkout and ticking the dedicated consent box, you (i) expressly request and consent to the immediate performance of the contract before the end of the 14-day withdrawal period and (ii) acknowledge that you thereby lose your right of withdrawal once the QR code has been dispatched to you.
Pre-dispatch cancellations: if you contact us before the QR code has been delivered to your e-mail, we will cancel the order and issue a full refund.
Post-dispatch: no refund is granted once the QR code has been delivered, except (i) where mandatory consumer law of your country of residence requires otherwise, or (ii) where the eSIM provably never functioned and GigSky confirms a technical fault not attributable to your device, configuration or the underlying public mobile networks.
Refund requests must be sent to hello@esimcruise.com within 14 days of the order date.
9. Acceptable use
You agree to use the Service only for lawful personal communications and not to: (i) breach any applicable law or third-party right; (ii) resell, rent or commercially redistribute the data plan; (iii) circumvent fair-use limits set by GigSky or the underlying carriers; (iv) use the Service for sustained machine-to-machine traffic, bulk messaging, spam or any abusive activity.
We may suspend or terminate the Service without refund in case of material breach of this clause.
10. Service availability and disclaimers
The Service is provided on an "as is" and "as available" basis. We do not warrant uninterrupted, error-free or fault-free operation, nor any specific throughput, latency or coverage at any specific location or time.
We are not responsible for events outside our reasonable control, including network outages, force majeure, governmental action, or restrictions imposed by cruise lines, ports or local authorities.
11. Limitation of liability
To the maximum extent permitted by Cyprus law, our aggregate liability arising out of or in connection with the Service is limited to the price actually paid by you for the order giving rise to the claim.
We exclude all liability for indirect, incidental, consequential or special damages, loss of profit, loss of data, loss of opportunity, missed bookings or excursions, additional roaming charges incurred on other networks, or reputational harm.
Nothing in these Terms limits any liability that cannot be limited under applicable mandatory law (including liability for death or personal injury caused by negligence, or for fraud).
12. Intellectual property
All trademarks, logos, text, design, graphics and software on esimcruise.com are owned by Black Fin LTD or its licensors and are protected by intellectual property laws. No right of use is granted other than viewing the website for the purpose of placing an order.
13. Changes to these Terms
We may amend these Terms from time to time. The version applicable to your order is the one published on the website at the moment your order is confirmed. Material changes will be highlighted on this page with the updated "Last updated" date.
14. Governing law and jurisdiction
These Terms and any non-contractual obligations arising out of them are governed by the laws of the Republic of Cyprus.
The competent courts of Nicosia, Cyprus, have exclusive jurisdiction over any dispute, subject to the mandatory consumer protection provisions of the country where you have your habitual residence within the European Union.
EU consumers may also use the European Commission Online Dispute Resolution (ODR) platform available at https://ec.europa.eu/consumers/odr.
